Functions and Duties of an Elder Law Attorney

Elder law attorneys and elder care attorneys deal with legal needs of the elderly – those typically above 65 years of age. Elder care attorneys also work on behalf of their disabled clients who are below 65 years of age and have similar long-term care needs to those of the elderly.

Duties of an Elder Care Attorney

One of the main functions of an elder care attorney is the provision of legal assistance in the case of will and estate planning of the elderly. The scope of elder law attorneys, however, extends to assisting the elderly with any legal issue they may have. These issues include:

  • Living wills – An elder law attorney helps to draft a will and advise on estate planning that protects the interests of the elder and the family.
  • Long-term care – An elder care attorney uses his experience and expertise to locate the right nursing home facility that will provide long-term quality care at an affordable cost that works for the elder and his family.

Nursing Home Care

An elder care attorney also keeps abreast with the deliverables promised by the nursing home and ensures that they carry out their obligations efficiently. Should the need arise; the elder care attorney defends the rights of the resident against neglect, negligence or improper treatment of the resident.

  • Guardianship – An elder law attorney advises the elder on the prudence of enabling a family member or any other responsible person to make decisions on his behalf with regard to his health, finances and legal issues if he becomes incapacitated.
  • Medicaid Eligibility – An elder care attorney advises on how to plan for long-term care while protecting your estate from being taken up with medical costs. The three main ways of paying for long-term care is either self-paying, long-term care insurance or Medicaid.

An elder care attorney helps to advice through the complicated web of Medicaid eligibility and by understanding the system guides the elder in a successful estate planning.

  • Probate administration and representation – An elder law attorney facilitates arrangements of estate administration and representation early in advance for the benefit of the family. In the event that disputes do arise after the passing of the elder, the elder law attorney helps in resolution of these disputes including matters of a contested will.

Factors to consider when choosing an elder care attorney

  • Expert and exclusive focus on elder law – Elder law can be very complex, detailed and ever-changing and the ideal elder care attorney is one who is intimately familiar with it and practices it regularly and seriously.
  • Experience – Long-term expertise and experience are the cornerstone of a successful elder care attorney who is able to handle each client’s case in an individualized and experienced manner.
  • Active and Good Listener – The ideal elder law attorney is one who takes the time to understand the client’s needs and specifications and is attentive to listen and care about your welfare and working together with you to craft the best solution.

Factors That Influence the Service and Maintenance of Radiation Equipment

There are several considerations to take into account when you’re servicing linear accelerators and maintaining radiation equipment. Linear accelerators and radiation equipment are critical and essential in any radiation oncology department but they are also quite expensive and complicated.

One of the biggest decisions to take into account is whether to rely on the Original Equipment Manufacturer (OEM) or to work with a servicing company whose main focus is servicing linear accelerators and maintaining radiation equipment.

While it may seem at first that the best cause of action would be to go with the OEM, there are several factors to consider alternative options such as:

Cost

Cost is a major factor to take into account and due to the complexity of servicing linear accelerators and maintaining radiation equipment; OEMs typically tend to charge a higher premium for service and maintenance.

Servicing companies on the other hand are able to offer a bundle of plans for you to choose from which can help to reduce costs, mitigate risk, or eliminate risk and protect your practice from unforeseen costs.

Focus of Service

The main business of OEMs is the manufacture and sale of equipment and equipment parts thus service and maintenance may not be the core of their business. With a servicing company whose main focus is servicing linear accelerators and maintaining radiation equipment, this facilitates greater efficiency and improved uptime.

Response time

The importance of medical equipment which underlies any medical facility is the optimal functioning of the equipment. Unforeseen machine breakdown can paralyze the operations of a practice. The speed at which medical equipment is returned to normal operating capacity is therefore critical.

For servicing companies, response times to servicing linear accelerators and maintaining radiation equipment is typically higher than OEMs since their services are structured to be available 24/7 with quick turnaround time for onsite responses.

Larger scope of operation

Most servicing companies have employed specialists and experts of different types of devices and brands so as to ensure effective servicing linear accelerators and maintaining radiation equipment. The service engineers are typically trained directly by the OEM manufacturers.

In addition, for practices that use different brands of oncology equipment, a servicing company is able to take care of the different requirements and specifications involved with servicing linear accelerators and maintaining radiation equipment in-house without involving different OEMS.

Flexible service contracts

Servicing companies are able to offer flexible service contracts which ensure comprehensive service for your oncology devices while controlling the service costs. Servicing companies are responsible for maintaining optimal uptime of the devices, carrying out scheduled maintenance and emergency repair service during the contract period.

The benefits of these flexible service contracts for servicing linear accelerators and maintaining radiation equipment include no charges for parts, effective cost control, scheduled preventive maintenance, no travel or call out charges, access to 24/7 support and optimal uptime guarantee for qualified devices. These flexible service contracts are therefore customized to meet the unique specifications and financial needs of your practice.

Ethical Considerations on Using Human Biologicals in Research

Human whole blood is a combination of human red blood cells (RBCs), various other cells, and plasma. For various experiments and research projects, these human biologicals are needed in order to come up with the research objectives and to provide a solution for any problem that is prevailing or that concerns the human body in general.  However, no matter how much important is any research. There are ethical issues that need to be addressed before going further into the research.

Why are these considerations important?

Ethical considerations govern the process and are needed for the betterment of the research and of the society as well. These considerations are important because they allow us to do something that is right and use our resources for the better tomorrow of the human race. There have been many mishaps in the past where researchers were not bound to follow these ethical rules and as a result, they committed some serious moral crimes.

The benefit of ethics is to teach every researcher that the value of an animal, human being or its biologicals is far greater than any experiment.

There are other benefits also.

  • Ethical considerations promote healthy experimentations where the researchers can find moral satisfaction.
  • Researchers governed by these rules are always supported by the general masses.
  • The test subjects involved find collaborating with each other fruitful and easy.
  • The research can be further extended into the future without a problem.

Why was there a need for such considerations?

The need for such considerations came because of the unethical experiments that took place in the past. The researchers such as the Tuskegee Experiment which used around 600 men who had contracted syphilis; Milgram’s Obedience Experiment which was abusive to the psychology of the test subjects; and Zimbardo’s Prison Experiment which led the subjects to violence and dangerous behavior are the reasons we have these ethical rules today.

How are they implemented?

One of the organizations which implement the ethics is National Commission for Protection of Human Subjects of Biomedical and Behavioral Research. Also, the Office for Human Research Protections is also doing a good job in preserving the ethics.

In numerous colleges and universities, certain communities like Institutional Review Boards (IRBs) are formed to check if the ethical codes are being applied.

What are the considerations?

Proper issues and considerations are well addressed in the UniSA online ethics system.

According to them, these considerations are:

  • The research that is being done should have value for the humans.
  • No researcher should expose his health to any kind of harm in the research.
  • The subjects’ consent should be the top priority.
  • The data or the results of the research should be handled with confidentiality.

The human biologicals of the human whole blood, only the human red blood cells, or any other biologicals should be treated under these ethical considerations at all cost not just for the health of the research but also for that of the humans in general.

Aluminum serves as raw materials for fence panels and it becomes tougher and stronger when it is fixed with other metals. There are varieties of aluminum fences. They come in various shapes, sizes, heights and styles.

Although, aluminum is silvery white in color, the application of a powder coating via an electrostatic process enables aluminum fences to come in various colors. Bronze, white and black colors are the most popular colors for aluminum fences. Areas of application of aluminum fences are office parks, apartment complexes, etc. An interesting feature of aluminum fences is that they are easily installed.

Fences can be purchased from a wholesaler. You can install it yourself by following the step by step installation instructions and save money in the process.

Benefits of Aluminum Fencing

When you seek fencing for your home, business or property, aluminum fences are among the best alternatives to consider.  Below are the benefits of considering aluminum fencing over other materials like steels, vinyl and wood.

  • Aluminum Fencing is Durable

Among impressive aspects of aluminum is its durability. Even with little maintenance, aluminum fences can last for many years.  The reason for this is because unlike iron and steel, aluminum does not readily react with its environment. It has a high immunity against rust, hence, a perfect choice for rain-prone and humid regions. Besides, aluminum possesses corrosion resistance properties, making it applicable in different environments for a long period of time.

  • Aluminum Is Strong and Lightweight Material

Aluminum is the lightest material available for making fences. Being lightweight brings other useful benefits. Its light weight enables it to be used for erecting light fences and reduce installation costs.

In addition, the light weight of aluminum ensures that the fence does not exert excessive pressure on the joints and posts. This will not only make them durable, but will lessen its maintenance costs.

  • Affordable

Aluminum is economical and cheaper when compared to wrought iron or steel. You can get a better fence which is made of aluminum, even at the same budget. Besides its low initial cost, the lifetime cost of aluminum is also low.

  • Easily Repaired and Maintained

Although aluminum is durable, some maintenance is required for its fences. Accidents and unpleasant weather conditions can warrant repairs of the fence. Notwithstanding, you need not worry about this as aluminum fences can be easily repaired in most cases. In fact, all that needs done in severe cases is a simple replacement of the damaged part or section. As the entire fence is not repaired, it lowers the overall costs.

As stated earlier, aluminum does not rust nor corrode, making you spend very little money and effort on their maintenance.  It is worthy to note that aluminum will never be damaged by dirt, insects or moisture. The only effort required of you is to occasionally clean its accumulated grime or dust.

  • Customizable

Many people will expect their aluminum fence to come in the conventional silvery-white color, as this is what they often know it to be. However, you are not restricted only to this form. Aluminum is customizable with diverse options. Hence, you will be able to find out what suits your desirable needs.

You will also be amazed to discover that aluminum fences can be painted over. This gives you the freedom for creativity. Aluminum can even be molded into assorted sizes and shapes. Hence, you are able to install stylish and unique fences.

  • Aluminum is Versatile

Aluminum can be used in various places due to its unique characteristics. You can use aluminum to make a pool fence or as a fence to grace your patio. All these and many others can be effectively done by aluminum.

  • Aluminum is Eco-Friendly

One of the best eco-friendly materials for fence is aluminum because it is durable and non-reactive. Your aluminum fence can be recycled later on, thereby reducing the impact on the environment.

TENNESSEE MEDIGAP AND WHY I NEED IT

Medicare is a U.S. federal health insurance that covers certain health expenses for senior citizens and other qualifying members of the society. Since it doesn’t cover every aspect of health insurance, there is a need for supplements. TN Medigap is one of those supplements. Medigap covers expenses such as foreign health care bills that are not covered by Medicare. Medigap, however, differs from Medicare Advantage Plans.

For one to be eligible for Medicare, there must be a history of tax payment. Medicare comes in different plans. Medigap plans are only available for persons with Medicare plans A and B. In Tennessee, there are over 806,000 persons registered for Medicare Plan A and/or Plan B. This is according to data released by the Centers for Medicare and Medicaid Services in 2017.

Medigap Plans To Choose From

Medigap, just like Medicaid also comes in plans which include Plan Plans A, B, C, D, F, G, K, L, M, and N. These plans come with specific coverage and make the payment out-of-pocket medical bills for senior citizens and persons with disabilities and others an easier process.

In Tennessee, all the ten standardized Medigap plans are available. The most popular Tennessee Medigap Policy is Plan F which has 161,323 enrolees as stated by America’s Health Insurance Plans (AHIP). This is distantly followed by Plans G, C, and N with 28,332, 17,876, 16,112, and 6,659 enrolees respectively. This data is according to an AHIP publication in 2015.

Issue- Age, Attained-Age, or Community

Medigap plans are either priced based in issue-age, attained-age or community. The premiums of attained-age rated plans increase as the insured gets older. For issue- age rated plans, increase in premiums may be as a result of inflation and other factors, but not age. However, the initial premium is based on age. Community-rated plans are offered at the same premium for everyone independent of age and other factors. Most of the plans in Tennessee are attained-age rated.

Medigap plans in Tennessee also include options for under 65s. The Kaiser Family Foundation states that all insurance companies must offer Medigap plans for persons being covered by Medicare plans under 65. This is, however, offered at a different premium rate. Please contact us for more details on this.

Medigap for Public and Education Sectors

In 2015 alone, 272,860 residents of Tennessee registered for a Medigap plan, according to AHIP. This is in the light The Tennessee Plan, a special Medigap plan that is state-sponsored and offered to retirees from the public and education sectors that have access to Medicare Part A. The Tennessee plan also has special benefits for those who spent at least 15 years in the public or education sector. These retirees get reduced premiums which have been extended to their spouses from 2015.

The different private insurance companies in Tennessee offer Medigap plans that vary in terms of premium, pricing and services covered.  And with the Tennessee plan, residents of TN get to enjoy better health care insurance service.
